(the “Treasure Hunt Official Rules”) carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter the Galbraith Literary Publishers Who Killed Ickey? Promotion, sponsored by Galbraith Literary Publishers Incorporated, including its wholly owned subsidiary, Who Killed Ickey? Treasure Hunt, Inc. (the “Sponsor”).By participating in the Promotion, you signify your agreement to these Treasure Hunt Official Rules and the Mini Puzzle Draws Official Rules (if you participate in the Mini Puzzle Draws), and the decisions of the Sponsor and RAVEN5 Ltd. (the “Administrator”).
If you do not agree to the Treasure Hunt Official Rules and the Mini Puzzle Draws Official Rules (if you participate in the Weekly Puzzle Draws), you may not enter the Promotion.
The Treasure Hunt is open to current legal residents of Canada (excluding Quebec), the fifty (50) United States of America and the District of Columbia who are at least eighteen (18) years of age or older at the time of entry (“Participant” or “entrant”, or “you”).
The Treasure Hunt can be played in teams of one (1) to six (6) eligible entrants (each group, a “Team”). Each Team must designate one (1) Team member to be the Team’s captain (a “Team Captain”) to complete the Team Registration Form and add each individual entrant to the Team list by providing the name and email address of each Team member. Once a Team Registration Form has been submitted, each individual Team member will receive a confirmation email notifying them that they have been added to the Team and requiring each Team member to click a link to complete the registration process. Each Team member, including the Team Captain, must follow the instructions to complete the individual registration form (all as further described below in Section 3. Treasure Hunt Registration Period & How to Register for the Treasure Hunt) in order to participate in the Treasure Hunt.
Employees, representatives, or agents of the Sponsor, the Administrator, Otherworldly Adventures LLC (“Otherworldly”), and each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies (the “Promotion Parties”) and all respective employees, shareholders, officers, directors, agents, members, licensees, successors and assigns of the foregoing and members of their immediate family (spouses, parents, children and siblings) or persons living in the same household are not eligible to participate in the Treasure Hunt.
The Treasure Hunt is subject to all applicable federal, state, provincial, municipal, territorial, and local laws and regulations. Sponsor reserves the right to verify eligibility requirements. False and/or deceptive entries or acts shall render an entrant and such entrant’s entire Team ineligible.
Participation in the Treasure Hunt constitutes your full and unconditional agreement to these Treasure Hunt Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Treasure Hunt. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void where prohibited by law.
Registration for the Treasure Hunt begins at 12:00:01 AM Pacific Time (“PT”) on September 14, 2023, and ends at 10:59:59 AM PT on January 27, 2024 (the “Treasure Hunt Registration Period”). To participate in the Treasure Hunt, each Team must complete the following steps prior to 11:00:00 AM PT on January 27, 2024:
Team Registration:
During the Registration Period, each Team Captain must visit https://ickeytreasurehunt.com/ (the “Treasure Hunt Website”) and follow the instructions to complete the online team registration form (the “Team Registration Form”). Each Team Captain must create a Team Name, Team Username and Team Password, provide his/her first name, last name, and email address, and optionally, provide the names and email addresses of the individual entrants that make up his/her team. Limit of six (6) entrants per Team. Please note: You must have permission from any third party prior to providing name(s) and email address(es) of any such individual on the Treasure Hunt website.
Individual Registration:
Once a Team Registration Form has been submitted, each Team member will receive a confirmation email notifying them that they have been added to the Team and requiring each Team member to click a link to complete the registration process. All individual Team members, including the Team Captain, must follow the instructions to complete the individual registration process as follows:

Entrants must complete all requirements as outlined herein by the earlier of (i) 10:59:59 AM PT on January 27, 2024, or (ii) the time an entrant’s Team commences the Treasure Hunt.
Each entrant must complete the Individual Registration form and complete or submit either: (i) a purchase entry, or (b) a no-purchase entry as outlined in these Treasure Hunt Official Rules, otherwise, such entrant will be deemed ineligible, and each individual member of his/her Team will be disqualified from the Treasure Hunt. If any entrant is deemed, at the discretion of the Sponsor and the Administrator, to be ineligible, or otherwise in non-compliance with these Treasure Hunt Official Rules, such entrant (and therefore, such entrant’s entire Team) will be disqualified and will not be eligible to win a prize in the Treasure Hunt.
More Information on Teams:
Each entrant is responsible for ensuring that each of their chosen individual Team members consent to participate in and are eligible to participate in the Treasure Hunt (as outlined in these Treasure Hunt Official Rules).
Each Team Captain is responsible for registering his/her Team and adding his/her Team members during the Team registration process. Team Captains may disclose the Team Username and Team Password to their Team members at any time after the Team has registered (at their own discretion), however, all Team members with the Team Username and Team Password will be able to login to the Team account to add or remove Team members at any time prior to starting the Treasure Hunt.
Team members may be added to or removed from a Team (prior to such Team starting the Treasure Hunt) by visiting the Treasure Hunt Website and logging in with the Team Username and Team Password and following the instructions to update Team members. Any Team member with the Team Username and Team Password will be able to add or remove Team members prior to starting the Treasure Hunt. The Promotion Parties are not responsible for any entrant that becomes disruptive or attempts to sabotage a Team.
To Participate in the Treasure Hunt, each Team member must login with the Team Username and Team Password as created by the Team Captain during the Team Registration process. Each Team Captain must disclose to his/her Team members, the Team Username and Team password in order to start the Treasure Hunt so that such Team members can login to their Team account to participate in the Treasure Hunt.
The Treasure Hunt begins at 10:00:01 AM PT on January 27, 2024, and ends at 4:30:00 PM PT on January 27, 2024 (the “Treasure Hunt Contest Period”).
Please note: each Team Captain must share the Team Username and Team Password with each of their Team members prior to beginning the Treasure Hunt in order for each Team Member to access the Treasure Hunt.
During the Treasure Hunt Contest Period, entrants must visit the Treasure Hunt Website and login with their Team Username and Team Password (as created by the Team Captain when completing the Team Registration Form) to log-in to their Team account.
Teams will be competing to solve the Treasure Hunt as quickly as possible once the Treasure Hunt begins at 10:00:01 AM PT on January 27, 2024. Each Team’s timer will begin at the start of the Treasure Hunt Contest Period (regardless of whether or not the Team does not start the hunt until after 10:00:01 AM PT) and will end as soon as the Team successfully submits the correct answer to the Final Meta Puzzle (as defined below). Otherworldly’s computer will be the official timekeeping device for the Treasure Hunt.
Any Team member may solve any unlocked puzzle for their Team. Once an entrant solves a puzzle, the Team dashboard will automatically update and each active Team member (that is logged into the Treasure Hunt Website) will receive a notification that the applicable puzzle has been solved. A Team’s progress can be tracked in the dashboard or by clicking “PUZZLES” on the Contest Website to view a list of unlocked puzzles. To unlock additional puzzles and progress in the Treasure Hunt, each Team must solve a certain number of puzzles during each round of the Treasure Hunt, as follows:
Round One (1) of the Treasure Hunt (“Round 1”):
At the start of the Treasure Hunt, each Team will be presented with a dashboard of eight (8) Round 1 puzzles. Four (4) Round 1 puzzles will be unlocked, and four (4) Round 1 puzzles will be locked at the start of the Treasure Hunt. For every two (2) Round 1 puzzles a Team solves, two (2) additional Round 1 puzzles will be unlocked, until all eight (8) Round 1 puzzles have been unlocked.
Once a Team solves six (6) of the Round 1 Puzzles, the Round 1 meta puzzle (the “Round 1 Meta Puzzle”) will be unlocked. To complete Round 1 and progress to Round 2 of the Treasure Hunt, each Team must correctly solve the Round 1 Meta Puzzle.
Round Two (2) of the Treasure Hunt (“Round 2”):
Once a Team has unlocked Round 2 of the Treasure Hunt, the Team will be presented with a dashboard of eight (8) Round 2 puzzles. Three (3) Round 2 puzzles will be unlocked, and five (5) Round 2 puzzles will be locked at the start of Round 2 of the Treasure Hunt. For each Round 2 puzzle a Team solves, one (1) or two (2) additional Round 2 Puzzle will be unlocked, until all eight (8) Round 2 puzzles have been unlocked.
Once a Team solves six (6) of the Round 2 Puzzles, the Round 2 meta puzzle (the “Round 2 Meta Puzzle”) will be unlocked. To complete Round 2 and progress to Round 3 of the Treasure Hunt, each Team must correctly solve the Round 2 Meta Puzzle.
Round Three (3) of the Treasure Hunt (“Round 3”):
Once a Team has unlocked Round 3 of the Treasure Hunt, the Team will be presented with the final meta puzzle (the “Final Meta Puzzle”). To complete the Treasure Hunt and end the Team’s timer, each Team must correctly solve the Final Meta Puzzle. Once a Team has correctly solved the Final Meta Puzzle and completed the Treasure Hunt, they will be presented with an onscreen message verifying that the Team has successfully completed the Treasure Hunt.
There are twelve (12) prizes available to be won in the Treasure Hunt, as outlined in the Prize Description Schedule below:

The Winners $5k Prize is a bonus prize in the Treasure Hunt that will be awarded by a random drawing to one (1) eligible entrant associated with a Team that wins the Grand Prize, Second Prize, Third Prize, Fourth Prize, Fifth Prize, Sixth Prize, Seventh Prize, Eighth Prize, Ninth Prize, Tenth Prize, or Eleventh Prize in the Treasure Hunt (each, a “Winning Team”) and who participated in and earned at least one (1) entry into the Galbraith Literary Publishers Who Killed Ickey? Mini Puzzle Draws. Only eligible entrants associated with a Winning Team and that participated in, and earned at least one (1) entry into the Galbraith Literary Publishers Who Killed Ickey? Mini Puzzle Draws will be eligible to participate in (and will automatically earn one (1) ballot into) the Winners $5k Prize draw.
Grand Prize:
The Team that solves the Final Meta Puzzle and completes the Treasure Hunt in the fastest time will be deemed the potential Grand Prize-winning Team, and each entrant associated with such Team will be deemed the potential Grand Prize winner(s), subject to verification of eligibility and compliance with these Treasure Hunt Official Rules.
Second Prize, Third Prize, Fourth Prize, Fifth Prize, Sixth Prize, Seventh Prize, Eighth Prize, Ninth Prize, Tenth Prize, and Eleventh Prize:
The ten (10) Teams that solve the Final Meta Puzzle and complete the Treasure Hunt in the next ten (10) fastest times (after the potential Grand Prize-winning Team’s time) will be deemed the potential Second Prize, Third Prize, Fourth Prize, Fifth Prize, Sixth Prize, Seventh Prize, Eighth Prize, Ninth Prize, Tenth Prize, or Eleventh Prize winning Teams, in order of fastest time. The entrants associated with the potential Second Prize, Third Prize, Fourth Prize, Fifth Prize, Sixth Prize, Seventh Prize, Eighth Prize, Ninth Prize, Tenth Prize, or Eleventh Prize winning Teams will be deemed the potential winners of the respective prizes, subject to verification of eligibility and compliance with these Treasure Hunt Official Rules.
Each member of a verified winning Team will be paid, directly by the Sponsor, a portion of the Team’s prize, which will be divided equally among each registered Team member. Such payment will be treated as taxable income to each individual Team member. Any information provided by the Sponsor to the IRS will reflect this treatment.
Should any entrant of a potential winning Team be disqualified for any reason, his/her entire Team will be disqualified, and his/her Team will forfeit any and all rights to the applicable prize, and the Team that solved the Final Meta Puzzle and completed the Treasure Hunt in the next fastest time will be deemed the potential Winning Team of the applicable prize (and each entrant associated with such Team will be deemed the potential winners of the applicable prize).
Should any Team be disqualified, (i) each potential winning Team that ranked below the disqualified Team in order of fastest time will move forward in the rankings, and (ii) the Team that solved the Final Meta Puzzle and completed the Treasure Hunt in the Twelfth fastest time will be deemed the potential Eleventh Prize winning Team (and each entrant associated with such Team will be deemed the potential winners of such prize). This process will be repeated until each potential winning Team has been verified as a Winning Team.
Winners $5k Bonus Prize:
The Winners $5k Prize is a bonus prize in the Treasure Hunt that will be awarded by a random drawing to one (1) eligible entrant associated with a Team that wins the Grand Prize, Second Prize, Third Prize, Fourth Prize, Fifth Prize, Sixth Prize, Seventh Prize, Eighth Prize, Ninth Prize, Tenth Prize, or Eleventh Prize in the Treasure Hunt (each, a “Winning Team”) and who participated in, and earned at least one (1) entry into the Galbraith Literary Publishers Who Killed Ickey? Mini Puzzle Draw. Only eligible entrants associated with a Winning Team and that participated in, and earned at least one (1) entry into the Galbraith Literary Publishers Who Killed Ickey? Mini Puzzle Draw will be eligible to participate in (and will automatically earn one (1) ballot into) the Winners $5k Prize draw.
How to Earn Bonus Ballots:
In addition, each entrant that is eligible to participate in the Winners $5k Bonus Prize draw will receive the total number of Bonus Share Entries that he/she earned throughout the Galbraith Literary Publishers Who Killed Ickey? Mini Puzzle Draws as bonus ballots into the Winners $5k Bonus Prize draw.Entrants that are eligible to participate in the Winners $5k Prize draw are limited to five (5) bonus ballots into the Winners $5k Bonus Prize draw during each of the ten (10) Entry Periods in the Mini Puzzle Draws, for a total of fifty (50) bonus ballots in the Winners $5k Bonus Prize draw (for such entrants that successfully solve all ten (10) Mini Puzzles in the Mini Puzzle Draws and share their Solved Message (as defined in the Mini Puzzle Draws Official Rules) to Facebook, Twitter, LinkedIn, Pinterest, and by email after solving each Mini Puzzle during each applicable Entry Period in the Mini Puzzle Draws).

Administrator will select the potential individual winner of the Winners $5k Bonus Prize in a random drawing conducted at Administrator’s offices from among all eligible ballots earned by each eligible entrant. Administrator’s and Sponsor’s decisions are final. The random drawing will be held on or about January 31, 2024.
Odds of winning the Winners $5k Bonus Prize will depend on the total number of eligible entrants that participated in both the Treasure Hunt and the Mini Puzzle Draws (and earned at least one (1) entry into the Mini Puzzle Draws), the total number of eligible entrants associated with each Winning Team, the total number of bonus ballots earned throughout the Mini Puzzle Draws by each entrant associated with a Winning Team, and each entrant’s (and each Team’s) ability to successfully solve the Treasure Hunt.
Grand Prize, Second Prize, Third Prize, Fourth Prize, Fifth Prize, Sixth Prize, Seventh Prize, Eighth Prize, Ninth Prize, Tenth Prize, and Eleventh Prize:
Administrator will notify each individual potential winner (each eligible entrant associated with a Winning Team) starting with individuals associated with the Grand Prize Winning Team using the email address submitted by such potential winner at the time of registration on or about January 29, 2024. Administrator will make a minimum of two (2) attempts to contact each potential winner.
If any potential winner cannot be contacted within seventy-two (72) hours of initial notification, after two attempts, as described above, including if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified.
Should any entrant of a potential Winning Team be disqualified for any reason, his/her entire team will be disqualified and will forfeit any and all rights to the applicable prize, and the Team that solved the Final Meta Puzzle and completed the treasure hunt in the next fastest time will be deemed the potential winning Team of such prize, subject to verification of eligibility and compliance with these Mini Puzzle Draws Official Rules.
Additional Requirements to Win the Grand Prize, Second Prize, Third Prize, Fourth Prize, Fifth Prize, Sixth Prize, Seventh Prize, Eighth Prize, Ninth Prize, Tenth Prize, or Eleventh Prize:
Individual potential winners will become confirmed winners (each a “Winner”) (and their Teams will each become a Winning Team) after meeting the requirements that follow. Failure to do so by any potential winner will result in disqualification of such potential winner’s entire Team, and the applicable prize may be awarded to an alternate eligible Team by the means set forth above.
Winners $5k Bonus Prize:
Administrator will notify the potential winner of the Winners $5k Prize using the email address submitted by the potential winner at the time of registration, on or about February 15, 2024. The potential winner of the Winners $5k Prize will be required to sign and return, within seventy-two (72) hours of notification, an additional release of liability and publicity release, and (if such entrant is a resident of the United States or the District of Colombia) may be required to complete and return a W9 (if he/she has not already done so) as a condition of acceptance of the Winners $5k Prize.
No Team is a Winning Team, and no one is a Winner unless and until the Sponsor or Administrator officially confirms him/her as a Winner in accordance with and as described in these Treasure Hunt Official Rules. Sponsor reserves the right, in its sole discretion, to disqualify any entrant or potential winner based on the results of any verification conducted at any time during the Treasure Hunt.
Prizes will be awarded within approximately 45 days after each Winner has been verified.
Except where prohibited by law, participation in the Treasure Hunt and acceptance of a prize constitutes permission for the Promotion Parties to use each Winner’s name, likeness, voice, photographs, biographical information, comments and other statements as well as his/her city, province/territory or state, and prize description for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
By participating in the Treasure Hunt, all entrants agree to forever and irrevocably release and hold harmless the Sponsor, Administrator, Otherworldly, each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies and all respective employees, shareholders, officers, directors, agents, members, licensees, successors and assigns of the foregoing (the “Released Parties”) from any and all liability for any loss, harm, damage, injury, cost or expense of any nature whatsoever (including attorneys’ fees) (collectively, “Losses“) which may occur in connection with (a) the Treasure Hunt or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any prize or component thereof, or (c) participation in any Treasure Hunt-related activity or prize-related activity including without limitation in each case any Losses that may be caused or contributed to by (1) any wrongful, negligent or unauthorized act or omission on the part of any of the Released Parties, or any of their independent contractors or any other person or entity not an employee of any of the Released Parties, or (2) any other cause, condition or event whatsoever beyond the control of any of the Released Parties. In addition, by participating in this Treasure Hunt, each entrant agrees to indemnify and hold harmless the Released Parties from and against any and all damages, losses, costs and expenses (including amounts paid in settlement and reasonable attorneys’ fees) incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of entrant hereunder, or (ii) entrant’s possession, use or misuse of any prize or component thereof.
Each entrant hereby acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize (or any components thereof) and that, except as prohibited by applicable law, prizes are provided “as is” without warranty of any kind, either express or implied. Released Parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement.
Without limiting anything set forth above in these Treasure Hunt Official Rules, Released Parties shall not have any obligation, responsibility or liability, including any obligation or responsibility to provide a prize to any Winner, with regard to: (a) entries entered through the use of any robotic or automated device/computer program or any other non-human mechanism, entity, or device; (b) entries in excess of the stated entry or ballot limit; (c) entries that are illegible, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with or in violation of these Treasure Hunt Official Rules, whether caused by any equipment or programming associated with or utilized in the Treasure Hunt or any other reason beyond Released Parties’ control; (d) any technical or human error which may occur in the creation, submission, assignment or processing of entries in the Treasure Hunt, including any technical or human error in connection with any social media platforms, Treasure Hunt Website and/or the hosting thereof; (e) entries, ballots, prize claims or notifications that are not received by the intended recipient due to transmission, technical, computer or human failures or error of any kind, including any entries, ballots, prize claims or notifications that are delayed, misdirected, or undelivered as a result of any failure or problem with the availability, functionality, operability or use of any network, server, ISP, website (including the Treasure Hunt Website), computer, internet connection, hand-held mobile device, social media platform, or any other equipment or connection used in connection with the Treasure Hunt; (f) changes in an entrant’s information which affects the ability to contact such entrant; (g) typographical errors in Treasure Hunt promotional material; (h) cancellations and/or delays or any change by any company or any other persons providing any of components of the prizes due to reasons beyond the control of any of the Released Parties; (i) any interruptions/postponement/cancellation of Treasure Hunt; (j) human error; incorrect or inaccurate transcription of registration information; (k) any technical malfunctions of the computer on-line system, computer dating mechanism, computer equipment, software, any social media platform, or internet service provider utilized by any of the Released Parties or by entrants; (l) interruption or inability to access the Treasure Hunt, any Treasure Hunt-related Web pages (including the Treasure Hunt Website), any social media platform, or any on-line service via the Internet due to hardware or software compatibility problems; (m) any damage to an entrant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Treasure Hunt; (n) any lost/delayed data transmissions, omissions, interruptions, defects; and/or (o) any other errors or malfunctions, even if caused by the negligence of any one or more of the Released Parties.
In the event of a dispute over the identity of an entrant, the entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any Participant or potential winner to provide Sponsor with proof that such party is the Authorized Account Holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void.
The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to Participant's or any other person's computer related to or resulting from participating in the Treasure Hunt.
By participating in the Treasure Hunt, you (i) agree to be bound by these Treasure Hunt Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Treasure Hunt.
Failure to comply with these Treasure Hunt Official Rules may result in disqualification from the Treasure Hunt. Sponsor reserves the right to: (i) permanently disqualify from any promotion it sponsors any person it believes has intentionally violated these Treasure Hunt Official Rules; and (ii) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Treasure Hunt).
If for any reason this Treasure Hunt is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Treasure Hunt, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, or to cancel, terminate, modify or suspend the Treasure Hunt.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY WEBSITE RELATING TO THE TREASURE HUNT OR INTERFERE WITH THE OPERATION OF THE TREASURE HUNT, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE TREASURE HUNT OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.
Any and all disputes, claims and causes of action arising out of or connected with this Treasure Hunt or any prize awarded shall be resolved exclusively by the appropriate federal or state court located in Wyoming, U.S.A., and all issues and questions concerning the construction, validity, interpretation and enforceability of these Treasure Hunt Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Treasure Hunt, shall be governed by, and construed in accordance with, the laws of the State of Wyoming, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Wyoming, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wyoming, U.S.A; Except where prohibited by law, all entrants agree that (i) any and all such disputes, claims, and causes of action shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Treasure Hunt, but in no event attorneys’ fees; (iii) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental, consequential and/or any other damages, other than actual out-of-pocket expenses; (iv) they waive any and all rights to have damages multiplied or otherwise increased; (v) they irrevocably consent to the personal jurisdiction of the aforesaid courts, as applicable to each such entrant and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have; and (vi) if any provision of these Treasure Hunt Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable, and that in any event, the unenforceability or invalidity of any provision will not affect any other provision of these Treasure Hunt Official Rules, and these Treasure Hunt Official Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS TREASURE HUNT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
Information collected through the administration of the Treasure Hunt is subject to and may be used and shared by Sponsor, including in connection with Sponsor’s administration of this Treasure Hunt to notify potential winners, verify and confirm winners, and to fulfill prizes, in accordance with Sponsor’s Privacy Policy at https://www.galbraithliterarypublishers.com/privacy-policy/ and applicable law.
Personal information collected will be stored on servers located in the United States and may be accessible to U.S. law enforcement, courts and other governmental institutions pursuant to the laws of the United States.
